Welcome to Mytelligent! These Terms of Use ("Terms") govern your use of the AURA wearable AI assistant, its Charging Case, and Anchor (collectively, the "Product"), as well as any related software, firmware, or services provided by Mytelligent ("Services"). By using the Product or Services, you agree to these Terms. If you do not agree, please do not use the Product or Services.
1. Acceptance of Terms
These Terms form a legally binding agreement between you and Mytelligent ("we," "us," or "our"). We may update these Terms from time to time by posting the revised version on our website. Your continued use of the Product or Services after such updates constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 13 years old to use the Product or Services. If you are under 18, you represent that you have parental or guardian consent to agree to these Terms.
3. Use of the Product and Services
3.1 Permitted Use
The AURA is a wearable AI assistant designed to provide personal assistance through voice and software interactions. You may use the Product and Services for personal, non-commercial purposes only, in accordance with these Terms and any instructions provided with the Product.
3.2 Restrictions
You agree not to:
Modify, reverse-engineer, disassemble, or attempt to derive the source code of the Product or Services.
Use the Product or Services for illegal, harmful, or unauthorized purposes (e.g., violating laws, infringing intellectual property, or harassing others).
Remove, alter, or obscure any proprietary notices (e.g., trademarks or copyright labels) on the Product or Services.
Interfere with the functionality of the Product, including its Charging Case or Anchor, or attempt to bypass any security measures.
Use the Product in a manner that could damage, disable, or overburden our systems.
3.3 Software Updates
The Product relies on firmware and software that may be updated periodically to improve functionality or security. You agree to install updates as they become available. Failure to update may affect performance, but does not void your warranty unless otherwise specified.
4. Ownership and Intellectual Property
The Product and Services, including all software, firmware, designs, and documentation, are owned by Mytelligent or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Product and Services as intended. No ownership rights are transferred to you.
5. Mytelligent Plus
If you enroll in the optional Mytelligent Plus plan (as described in our Warranty and Returns policy), additional benefits (e.g., extended warranty, priority support, exclusive updates) apply. Enrollment is subject to separate terms provided at purchase, but these Terms still govern your use of the Product and Services.
6. Privacy
Your use of the Product and Services is also subject to our Privacy Policy [insert link if applicable], which explains how we collect, use, and protect your personal information. By using the Product, you consent to such processing.
7. Disclaimers
7.1 As-Is Basis
The Product and Services are provided "as is" and "as available," without warranties of any kind beyond those expressly stated in our Warranty and Returns policy. We do not guarantee that the Product or Services will be uninterrupted, error-free, or meet your specific expectations.
7.2 Limitations
The AURA is not a medical device, emergency tool, or substitute for professional advice. Do not rely on it for critical health, safety, or legal decisions.
8. Limitation of Liability
To the fullest extent permitted by law, Mytelligent, its affiliates, and licensors will not be liable for any indirect, incidental, consequential, or punitive damages (e.g., loss of data, profits, or use) arising from your use of the Product or Services, even if advised of the possibility of such damages. Our total liability to you will not exceed the amount you paid for the Product.
9. Indemnification
You agree to indemnify and hold Mytelligent harmless from any claims, damages, or losses (including legal fees) arising from your misuse of the Product or Services, violation of these Terms, or infringement of third-party rights.
10. Termination
We may suspend or terminate your access to the Services (e.g., software updates or support) if you violate these Terms. Upon termination, you must cease using the Product and Services. Sections 4, 7, 8, 9, and 11 survive termination.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Las Vegas, Nevada. You waive any objection to venue or jurisdiction in such courts.

13. Miscellaneous
Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any right or provision does not waive it.
Entire Agreement: These Terms, along with our Warranty and Returns policy and Privacy Policy [if applicable], constitute the entire agreement between you and Mytelligent regarding the Product and Services.
